Welcome to DaanSetu. These Terms and Conditions govern your use of our crowdfunding platform located at https://daansetu.in (“Site”). By accessing or using DaanSetu, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Site.
1. Definitions
- “User,” “You,” or “Your” refers to any individual or entity that registers on or uses the Site.
- “Campaign” means a fundraising project created by a User to raise funds via the Site.
- “Backer” means a User who pledges or donates funds to a Campaign.
- “Platform” refers to the Site and all related services provided by DaanSetu.
2. Eligibility
Users must be at least 18 years old and capable of entering into a binding contract. By using the Site, you represent and warrant that you meet these requirements.
3. Account Registration
- Account Creation: Users must register with a valid email and create a password.
- Accuracy: You agree to provide true, accurate, and complete information.
- Security: You are responsible for safeguarding your credentials and all activities conducted under your account.
4. Campaign Creation & Management
- Approval: All Campaigns are subject to review. DaanSetu reserves the right to approve, modify, or reject any Campaign at its discretion.
- Responsibilities: Campaign Creators must ensure that all information—goals, deadlines, descriptions—is accurate and lawful.
- Fees & Commissions: DaanSetu charges a platform fee of X% on funds raised, plus any payment processing fees.
5. Donations & Payments
- Payment Processing: All transactions are handled by third-party gateways (e.g., Razorpay, Stripe).
- Refunds: All donations are final. Refunds are granted only if a payment fails or by express agreement.
- Payouts: Campaign Creators may request withdrawal upon reaching their funding goal; payouts are subject to identity verification and applicable fees.
6. Intellectual Property
All content on the Site—including text, graphics, logos, and software—is the property of DaanSetu or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.
7. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations.
- Post false, misleading, or infringing content.
- Engage in fraudulent activities or manipulations of funding.
- Interfere with the security or functionality of the Site.
8. Disclaimers & Limitation of Liability
- No Warranty: The Site is provided “as is” without warranties of any kind.
- Limitation: DaanSetu’s liability for any claim arising out of or relating to these Terms is limited to the total fees paid by the User in the preceding 12 months.
9. Termination
DaanSetu may suspend or terminate your access at any time for violation of these Terms or for any other reason.
10. Changes to Terms
We may update these Terms periodically. We will notify you by posting the new “Last updated” date. Continued use after changes constitutes acceptance.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes will be resolved by binding arbitration in Mumbai, India.
